Terms & Conditions of Service / Hosting & Website Design

 

Your Account

a)  Your account will be setup once we have received payment, and not before.  You must provide us with a contact email address and postal address, in which we can send you these details in a secure and safe way.  You agree to provide accurate and truthful information when you sign up for our services.  You also agree to keep up notified of any changes in your information (ie your email, address etc).  This is to ensure your account remains uninterrupted.

 

b)  If you have bought one of our websites from ebay, please note that you will still need to complete the hosting registration process for the subscription hosting service.  If the ebay website design package you have purchased did not come with any hosting, then you agree to signup for your hosting with eezyhost within 7 days of winning the auction.

 

c)  You represent, undertake and warrant to us that you will use the website for lawful purposes only which includes but not limited to:-

copyright material, threatening/abusive/malicious/defamatory/obscene/pornographic or otherwise objectionable in any way, any material containing a virus or other hostile computer programs.  We have a ZERO tolerance policy on Spamming and bulk emailing.  Please view our policies section.

 

d)  All payments/charges payable by you for the services received by our business, will be made in advance.  You agree, that unless you notify us of your wish to cancel your hosting with us, then services will be charged on a reoccurring basis.  eezyhost reserve the right to change/alter the costs at any time.  However should we do so, then you will be notified.  Your hosting fees once purchased, will not change from the date of your purchase. 

 

e)  eezyhost is not responsible for your information on your website and/or details you have provided on your account.  You acknowledge that you use the hosting service at your own risk and you agree to take full responsibility for all the information, files and data you provide.  You must arrange to make your own regular backups of your information you have stored on our services, as eezyhost will not be responsible for any lost data or work on our servers due to malfunction or system error.

 

f)  eezyhost reserve the right to cancel your account at any time.  eezyhost will be entitled to suspend your account without notice if you fail to pay any sums due to us as they fall due, break any of terms and conditions, are a company and you go into Administration.  You agree that no refunds will be made by eezyhost under any circumstances for services/account suspension.  You may cancel your account at any time as you are not bound to any contractual ties to eezyhost.

 

g)  You may not use our servers to:

- Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
- Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
- Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Run any software that interfaces with an IRC (Internet Relay Chat) network.
- Run any bit torrent application, tracker, or client.
- Participate in any file-sharing/peer-to-peer activities
- Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
 

h) You are allocated a monthly bandwidth allowance. This bandwidth allowance varies, depending on the hosting package you purchase. Should your account go over the allocated amount, we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

 

i)  eezyhost shall use endeavour to make available to you at all times, the Server and Services, but we shall not, in any event, be liable for interruptions or Service or down-time of our Servers.

 

j)  You shall indemnify us and keep us indemnified and hold eezyhost harmless from and against any breach by you of these terms and conditions and against any claim brought against us by a third party that may arise or result from any service provided or performed or agreed to be performed or any product sold by eezyhost.  You shall agree to indemnify and keep us indemnified and hold eezyhost harmless against liabilities including, but limited to, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses - including legal costs and expenses, suffered or incurred by eezyhost.  You shall agree to indemnify and keep us indemnified and hold eezyhost harmless against liabilities arising out of, any injury to property or person caused by any products or services sold by or distributed in connection with eezyhost, any copyright infringement, any defective products or services sold to you from eezyhost.  In no event, shall eezyhost be liable to you for any loss of business, contracts, profits or for any other indirect or consequential or economic loss whatsoever.

 

k) eezyhost shall not be responsible for any damages your business may suffer. eezyhost makes no warranties of any kind, expressed or implied for services we provide. eezyhost disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by eezyhost.
